What are the grounds for divorce in Florida?
Florida is a “no-fault” divorce state, so you need to demonstrate only one of the following “grounds” (reasons) to proceed: Your marriage is irretrievably broken beyond repair, or your spouse has been declared mentally incapacitated by a court for at least three years.
How long do I have to live in Florida to file for divorce?
At least one spouse must have lived in Florida for at least six months before a divorce petition can be filed. This residency requirement is necessary for the court to have jurisdiction (authority) over the case. It is not necessary for the marriage to have been created in Florida, nor do both spouses have to live here for the divorce to proceed.
How long does it take to get a divorce in Florida?
Getting a divorce in Florida can take months to years, depending on whether your divorce is uncontested or contested.
If your divorce is uncontested, meaning that you and your spouse are able to agree on all the issues that must be settled, you can theoretically get a divorce as soon as the mandatory 20-day waiting period from the date of filing has passed. In practical terms, due to the need for negotiations and the court’s own timeline, it may take a minimum of four to six weeks and a maximum of a few months.
If your divorce is contested, meaning that some issue is in dispute (such as child custody or some aspect of asset division), your divorce can take much longer. There will be negotiations, discovery and possibly even a trial so that a judge can ultimately decide what should happen. Contested divorces can take well over a year – and sometimes several.
